              Public offer (agreement) for the provision of services for temporary placement

Services are provided by the Mountain Residence hotel chain, which is located at the address: Ivano-Frankivsk region, with. Polyanitsa, Vishnya tract, 504 (hereinafter referred to as the Hotel), and include: accommodation of individuals, by providing a room (place) for temporary residence.

Acceptance of the offered services at the Hotel is considered that you fully and unconditionally agree with all the conditions of the following Public offer (agreement) on the provision of services, the rules of staying at the hotel, booking conditions, in full and unconditionally accept them (including agree to fulfill all obligations that are imposed on you by the Public Offer (Agreement) for the provision of services and the rules of staying at the hotel) and you understand all their provisions. The public offer (agreement) for the provision of services, the rules of residence and the conditions for booking at the Hotel, determine the content of the rights, obligations and responsibilities of the Hotel and the User, act simultaneously and complement each other.

1. General Provisions

1.1. This Public Offer defines the terms of the contract in accordance with Art. 641 of the Civil Code of Ukraine and is an official Public Offer addressed to other persons (hereinafter - "User", or "Users", or "Client", or Consumer, or "Consumers", or "Guest" or "Guests"), conclude an agreement on the provision of accommodation services to the User (provision of a room (place) for temporary residence) on the conditions set forth below.

1.2. Hereinafter, in the text of the Public Offer (Agreement), the Hotel and the User are collectively referred to as the "Parties", and separately - the "Party".

1.3. Each Party guarantees to the other Party that it has the necessary legal capacity, as well as all the rights and powers necessary and sufficient to conclude and execute the Agreement in accordance with its terms.

1.5. The User consents to the communication to third parties of information that arises in connection with the implementation of this Public Offer (agreement) and the receipt by the User of services from the Hotel.

2. Offer (public offer) / Subject of the contract

2.1. The subject of the Public Offer / Agreement is the provision of accommodation services by the Hotel to the User for a fee, by providing a room (place) for temporary residence at the address of the hotel, in a specially equipped living room (room) in accordance with the booking order.

2.2. The agreement is considered concluded and takes effect from the moment the Client takes any action provided for in clause 3.4 of the agreement, which means the Client's full and unconditional acceptance of all the terms of the agreement and the booking conditions without any exceptions and / or restrictions in accordance with Article 642 of the Civil Code of Ukraine. The agreement on the provision of accommodation services concluded by the Client (user) through the acceptance of the Public Offer has legal force in accordance with Article 642 of the Civil Code of Ukraine and is equivalent to an agreement signed by the parties and it is considered that the User has read and agrees with the terms of booking and this public offer agreement.

3. Procedure for concluding a contract

3.1. The agreement is concluded between the hotel and the User in the form of an accession agreement (Art. 634 of the Civil Code of Ukraine).

3.2. Acceptance (acceptance) of the Public Offer is the implementation by the User of any actions determined

clause 3.4 of the Agreement.

3.3. Acceptance (acceptance) of the Public Offer means full, unconditional and unconditional acceptance by the User of all the terms of the agreement without any exceptions and / or restrictions and is equivalent to Part 2 of Art. 642 of the Civil Code of Ukraine to the conclusion by the Parties of a bilateral written agreement on the conditions set forth in this public offer.

The conclusion of the contract means that the User: - fully familiarized himself with and agrees with the rules of stay at the hotel; - recognizes the unconditional suitability of the hotel premises to meet the needs described in this agreement;

- accepts all the terms of this agreement without comments or objections.

3.4. The user, in accordance with Article 642 of the Civil Code of Ukraine, confirms the fact of acceptance (acceptance) of the Public Offer if any of the following actions are performed:

- payment for temporary accommodation services through the reception and accommodation service (reception) or by bank transfer based on issued invoices, or by credit card;

- direct use of the hotel services by the user (settlement)

- filling out the registration form / receipt / questionnaire at the reception.

3.5. The User undertakes to independently enter (inform) upon registration, to receive services to the Hotel, reliable personal data and information that corresponds to reality.

3.6. The term for accepting this public offer is not limited.

4. Settlement procedure

4.1. Hotel services are provided to the User on a paid basis in accordance with the terms of the contract and the tariffs / prices indicated on the price tags, price lists, other information documentation of the hotel and / or on the hotel website, taking into account the selected category of rooms. Tariffs / prices for hotel services and their list are determined and changed solely by the sole decision of the Hotel.

4.2. The right to receive / use the services of the Hotel, as a rule, is granted after the payment for the relevant services has been made, according to the Tariffs / Prices. The hotel has the right to provide services to the User without making an advance payment.

4.3. The hotel has the right to apply free prices and discounts for temporary accommodation services.

4.4. Payment for services at the Hotel is carried out in cash or by bank transfer.

4.5. After the paid period of stay, the User is obliged to leave the room and release it from personal belongings and luggage no later than 12:00 hours Kiev time (check-out time) of the last paid day of stay or pay for the extension of the period of stay in the room for the lack of booking the specified number by third parties.

4.6. Check-in time at the Hotel starts at 15:00 Kiev time.

4.7. Early check-in and late check-out is an additional service that is paid taking into account the selected category of rooms in accordance with the prices indicated on information boards, price lists, other information documents of the hotel and / or on the hotel website.

5. The procedure for registration of hotel accommodation. The procedure for early termination of the provision of accommodation services at the initiative of the user

5.1. Accommodation of the User in the Hotel, as a rule, is carried out on a preliminary paid basis, that is, upon making 50% of payment for services (in the New Year period 100%) for temporary accommodation for a period agreed with the reception in accordance with the prices indicated on information stands, other information documentation Hotels and / or on the hotel website, with the simultaneous presentation by the User of the reception of documents proving his identity (passport of a citizen of Ukraine, including for traveling abroad, birth certificate - for persons under 16 years of age unaccompanied by parents, guardians, etc. ., passport of a citizen of a foreign state or stateless person, migration card), as well as filling out a user questionnaire at the reception of a certain form. In the absence of the above documents, the User recognizes the right of the receptionist to refuse to provide services for temporary accommodation at the Hotel.

5.2. If the user refuses the booked service or changes the start and / or end date of the service for any reason beyond the hotel's control, changes in the conditions of the service at the initiative of the user after paying for it is equivalent to a refusal (partial refusal) of the service, and the Hotel is retained ( charged) the amount of 100% of the cost of living.

6. Force majeure

6.1. In the event of force majeure circumstances: war, floods, earthquakes, fires, strikes, epidemics, changes in legislation, etc., the parties are partially or completely released from fulfilling their obligations under this agreement.

6.2. The Party for which the impossibility of fulfilling the obligations assumed due to force majeure circumstances has been created is obliged to notify the other Party in writing about the time of occurrence and termination of these circumstances.

6.3. The effect of force majeure must be confirmed by the appropriate competent authority.

7. Accommodation of children

7.1. For accommodation in a room for one child up to 5 years old inclusive, in excess of the established number of people living for the corresponding category of room, the fee for temporary accommodation services is not charged.

7.2. The conditions for admission and accommodation of groups of children accompanied by adults are regulated in each individual case individually, by signing a separate agreement.

8. Rights and obligations of Users of accommodation services at the Hotel

8.1. Accommodation service users have the right to:

- use accommodation services and additional services in the manner specified in this Public Offer and in the rules of staying at the hotel, other documents of the Hotel;

- receive complete and reliable information about the hours of access to the hotel territory,

the cost of services on the territory of the hotel;

- contact the reception staff regarding the quality of the temporary accommodation service, leave complaints, reviews and suggestions in the complaints and suggestions book, which is located in the consumer's corner.

9.2. Accommodation service users must:

- unconditionally adhere to the terms and conditions of this Public Offer;

- respect the rights of other hotel guests;

- adhere to moral and ethical standards, refrain from using obscene expressions in public areas of the hotel;

- comply with the rules of staying at the Hotel, the rules for using the hotel's infrastructure facilities, the rules for accessing them, which can be found at the reception;

- to protect the property of the Hotel. In case of loss or damage through the fault of the user of property (including towels, bathrobes, dishes, furniture, various inventory, etc.), which are located on the territory of the hotel, the guest is obliged to within 2 calendar days, but no later than the date of check-out from the hotel to compensate the damage, the amount of which is determined: in accordance with the prices indicated on the information stands, in the consumer's corner, menu, price tags, price lists, other information documentation of the hotel and / or on the hotel website, and in the absence of such prices - by a commission as part of the administrator , the receptionist and any other employee of the hotel on a transparent basis and at the market value of the lost or damaged property;

- comply with the rules of fire safety and rational (economical) use of electrical appliances and equipment of the Hotel.

10. Rights and obligations of the Hotel

10.1. The hotel must:

- timely, efficiently and in full provide the User with paid services;

- inform the user about the services provided on the territory of the hotel, the form and procedure for their payment;

- ensure full compliance of services with sanitary and epidemiological standards and rules;

- promptly respond to users' requests regarding the provision of temporary accommodation services, taking measures to eliminate breakdowns and accidents in the hotel rooms as soon as possible (if it is impossible to eliminate the accident or breakdown in the room, if possible, another category number is provided not lower than the one that was agreed on the day of arrival)

- be responsible for the completeness and serviceability of the equipment in the rooms, as well as for the quality of the room preparation for check-in;

The hotel is not responsible for money, things and any other material values ​​left in the room, lost on the territory of the hotel, or their loss for any reason.

10.2. The hotel has the right to:

- enter the hotel room for cleaning, changing linen, checking water supply systems, air conditioning or eliminating deficiencies in their functioning, as well as in case of violation by the User of the provisions of this Public Offer;

- in case of the end, agreed with the reception and 100% of the paid period of the user's stay in the Hotel and / or the user's absence at the place of temporary residence for more than 2 hours without payment, independently release the room from the user's personal belongings, while compiling an inventory of the property left by the User;

- in case of more than two violations by the User of generally accepted norms of behavior, invite employees of the internal affairs bodies to clarify the circumstances and establish the facts of such violations;

- early, without refunding paid funds to Users for temporary accommodation, terminate the contract for the provision of temporary accommodation services, with simultaneous forced eviction from the hotel in the event of:

- being in a state of strong alcoholic and / or narcotic and / or toxic intoxication or under the influence of psychotropic substances;

- smoking in the rooms, as well as on the territory of the hotel and the complex, except for specially designated places;

- storage or bringing of weapons, explosive and flammable, caustic, poisonous, narcotic drugs and other dangerous items and substances without the approval of the reception and without proper permits;

- violation of the rules of public order;

- violation of the rules of staying at the Hotel;

- violation of the provisions of this Public Offer;

- systematic (2 or more) complaints from other hotel guests about violation of their rights and freedoms.

11. It is prohibited on the territory of the hotel:

- invite and escort strangers to the rooms;

- transfer to third parties the key (card, bracelet, etc.) from the number;

- to store large things and items in the room, except for suitcases (boxes, boxes larger than 100x100x100 cm, bicycles, scooters, mopeds, etc.);

- move furniture and move interior items;

- smoke in rooms and other places that are not intended for smoking;

- disturb the peace of other hotel guests after 22:00 (on holidays after 24:00), creating a scream or noise;

- to store or bring weapons, explosive and flammable, caustic, poisonous, poisonous, drugs and other dangerous items. Users who have the right to carry and store weapons are required to report this at the reception on the day of arrival, presenting the appropriate permits;

- to take out dishes and cutlery from rooms and outside;

- deliberately pollute the hotel territory with cigarette butts, garbage, etc .;

- to throw any objects and things from balconies or windows;

- use your own electric heaters, boilers, kettles, etc., which are not included in the room package;

- light candles.

In the event of more than two violations, or one-time gross violation by the guest of the rules of conduct and / or obligations specified in sections 9-11 of this Public Offer, the reception (hotel) has the right to refuse the guest to further provide services for temporary accommodation, and then stay at the hotel. with the obligatory drawing up of an appropriate act and, if necessary, with the involvement of law enforcement officers.

Users acknowledge the hotel's right not to provide temporary accommodation services to persons who:

- in the opinion of the reception, they are in a state of strong alcoholic and / or narcotic and / or toxic intoxication or under the influence of psychotropic substances;

- preserve (bring) weapons, explosive and flammable, caustic, poisonous, narcotic drugs and other dangerous items and substances without the consent of the reception and without proper permits;

- did not provide identity documents;

- intend to move into the room by more people than paid for or the corresponding category of the room provides.

12. Dispute Resolution

12.1. In case of complaints, the User must provide: a complaint, a receipt (receipt, etc.) of the Hotel, a document with the Hotel's mark confirming the violation of the terms of service, documents confirming actual losses. Complaints and all necessary documents are provided to the Hotel no later than 14 days after the end of the service. All complaints are considered by the hotel only on condition that the hotel was informed of the violation of the terms of service in advance to be able to eliminate them within the next 12 hours.

12.2. The hotel will consider the received complaint within 20 days.

12.3. Complaints filed in violation of the requirements of the Public Offer (agreement) are not considered.
